This document outlines the terms governing your use of Naksha. Please read carefully before using our services.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Arthaprapti Fintech Solutions Pvt. Ltd., a company incorporated under the laws of India, having its registered office in Ranchi, Jharkhand (DPIIT Recognition No. DIPP250684) ("Company," "we," "us," or "our"), governing your access to and use of the Naksha (नक्शा) platform, including our website, mobile applications, and all related services (collectively, the "Service").
By creating an account or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
1. Definitions
The following terms shall have the meanings ascribed to them below, wherever capitalised throughout these Terms:
- "Naksha" (नक्शा) — The privacy-first family financial address book platform operated by the Company. Naksha stores only the metadata of financial instruments (such as institution names, branch names, instrument types, and nominee details), and never stores account numbers, passwords, PINs, PAN numbers, Aadhaar numbers, or any other sensitive credentials.
- "Financial Address Book" — The core feature of Naksha that allows Users to catalogue the metadata of their financial instruments (bank accounts, insurance policies, investments, loans, properties, and the like) in one secure, organised record.
- "Life Signal"— Naksha's proprietary WhatsApp-based periodic check-in system, designed to verify the well-being of the primary User. The Life Signal follows a 9-step escalation protocol. Step 9 (final release of information to nominees) is never automated and always requires manual verification by the Company.
- "Margdarshak" — A trusted guide or advisor designated by the User within Naksha, who may assist nominees in understanding and acting upon the financial metadata shared with them upon release.
- "Digital Tijori" — The encrypted digital vault within Naksha where User-supplied financial metadata is stored using AES-256-GCM encryption with envelope encryption via AWS KMS.
- "Readiness Score" — A proprietary metric calculated by Naksha that indicates how comprehensively a User has recorded their financial metadata and configured nominee access, expressed as a percentage.
- "Nominee"— An individual designated by the User to receive access to the User's financial metadata under the terms and conditions of the Life Signal protocol.
2. Service Description
Naksha is a privacy-first family financial address book that helps Indian families ensure that critical financial information is never lost when a loved one passes away or becomes incapacitated. The Service enables Users to:
- Record and organise the metadata of their financial instruments, including institution names, branch details, instrument types, nominee names, and related reference notes.
- Designate nominees and a Margdarshak who will receive this metadata through the Life Signal protocol when circumstances require it.
- Monitor their Readiness Score to track how thoroughly their financial affairs are documented.
- Store essential documents in the Digital Tijori with end-to-end encryption.
What Naksha Stores
Naksha exclusively stores metadata — descriptive information about financial instruments. This includes institution names, branch names, instrument types (savings account, term insurance, mutual fund, etc.), nominee names, and general notes provided by the User.
What Naksha Never Stores
Naksha never collects, stores, processes, or transmits:
- Bank account numbers or credit/debit card numbers
- Passwords, PINs, CVVs, or OTPs of any financial institution
- PAN (Permanent Account Number) details
- Aadhaar numbers or biometric data
- Net banking or mobile banking credentials
- Any other sensitive authentication credentials
Users are expressly prohibited from entering such information into any field within the Service. If the Company discovers that sensitive credentials have been entered, it reserves the right to delete such data without notice to protect the User.
3. User Obligations
By using the Service, you agree to the following obligations:
- Accuracy of Information: You shall provide accurate, current, and complete information when creating your account and recording financial metadata. You are solely responsible for the accuracy of all data entered into Naksha.
- Lawful Use: You shall use the Service only for lawful purposes and in accordance with these Terms. You shall not use Naksha to facilitate any illegal activity, including but not limited to money laundering, tax evasion, fraud, or concealment of assets.
- Credential Security: You are responsible for safeguarding your login credentials (phone number, password, and OTP access). You must not share your account credentials with any third party. You shall immediately notify us at info@arthaprapti.com if you suspect unauthorised access to your account.
- Prohibited Content: You shall not upload, enter, or store any sensitive financial credentials (account numbers, passwords, PAN, Aadhaar, etc.) into the Service. Naksha is designed for metadata only, and you acknowledge this limitation.
- Nominee Consent: You represent and warrant that you have obtained the consent of all individuals you designate as nominees or as your Margdarshak before entering their personal information into Naksha.
- Single Account: Each individual may maintain only one Naksha account. Creating multiple accounts is a violation of these Terms and may result in termination of all associated accounts.
4. Account Registration & Authentication
To access the Service, you must create an account by providing a valid Indian mobile phone number. The registration and authentication process is as follows:
- First Login: Your initial login is authenticated via a One-Time Password (OTP) sent to your registered mobile number via SMS or WhatsApp. Upon successful OTP verification, you will be prompted to set a password for subsequent logins.
- Subsequent Logins: After your first login, you may log in using your registered mobile number and password. OTP-based login remains available as a fallback option.
- One Account Per Person: Each mobile number may be associated with only one Naksha account. We may verify your identity through additional means at our discretion to prevent duplicate accounts.
- Account Security: You are responsible for all activities that occur under your account. We recommend using a strong, unique password and keeping your registered mobile number secure.
5. Subscription & Payment
Naksha operates on an annual subscription model. The following plans are currently available:
- Raah (राह): ₹1,499 +GST per year — designed for individuals. Includes one User profile with nominee designation and Life Signal activation.
- Saath (साथ): ₹2,999 +GST per year — designed for couples. Includes two User profiles with shared nominee designations and Life Signal activation for both.
- Virasat (विरासत): ₹4,999 +GST per year — designed for families. Includes up to four User profiles with comprehensive nominee designations, Margdarshak support, and Life Signal activation for all members.
Payment Processing
All payments are processed securely through Razorpay, a PCI-DSS compliant payment gateway. We do not store your payment card details on our servers. Your payment information is handled entirely by Razorpay in accordance with their terms of service and privacy policy.
Billing Cycle & Renewal
Subscriptions are billed annually from the date of purchase. Auto-renewal is optional and can be enabled or disabled at any time from your account settings. If auto-renewal is enabled, your subscription will be renewed automatically at the then-current price unless you cancel before the renewal date.
Pricing Changes
We reserve the right to modify subscription pricing. Any pricing changes will be communicated to existing subscribers at least 30 days in advance via email or in-app notification. Price changes will take effect at the start of your next billing cycle. If you do not agree with the revised pricing, you may cancel your subscription before the renewal date.
Refund Policy
Refund requests are governed by our separate Refund & Cancellation Policy. Please refer to that document for details on eligibility, timelines, and the refund process.
6. Data Handling
We take the security and privacy of your data with the utmost seriousness. The following outlines our data handling practices:
Encryption
All financial metadata stored within Naksha is encrypted using AES-256-GCM (Advanced Encryption Standard with 256-bit keys in Galois/Counter Mode), which is the same encryption standard used by banks and government agencies. We employ envelope encryption via AWS Key Management Service (KMS), ensuring that encryption keys are themselves encrypted and managed with hardware-level security.
Data Residency
All User data is stored exclusively on servers located within India. We do not transfer, replicate, or process User data on servers outside of Indian territory, in compliance with Indian data localisation requirements.
Metadata-Only Architecture
By design, Naksha only processes and stores financial metadata (as defined in Section 1). This architecture minimises risk exposure, because even in the unlikely event of a data breach, no actionable financial credentials would be compromised.
Compliance
Naksha is designed to comply with the Digital Personal Data Protection (DPDP) Act, 2023 of India, including requirements related to purpose limitation, data minimisation, storage limitation, consent management, and the rights of data principals. We also adhere to applicable provisions of the Information Technology Act, 2000 and its associated rules.
Data Retention
Your data is retained for the duration of your active subscription and for a period of 7 years following account closure, as required by applicable Indian financial and tax regulations. After the retention period, data is permanently and irreversibly deleted using cryptographic erasure methods.
7. Nominee Access & Life Signal
The Life Signal is one of Naksha's most critical features. It is designed to ensure that your financial metadata reaches your designated nominees if you are no longer able to manage it yourself, while preventing premature or unauthorised release.
9-Step Escalation Protocol
The Life Signal operates through a carefully designed 9-step escalation protocol. When a periodic check-in is missed, the system initiates the escalation sequence:
- Steps 1–3: Automated reminder messages sent to the User via WhatsApp, SMS, and email at increasing intervals, requesting confirmation of well-being.
- Steps 4–6:Escalation to User-designated emergency contacts and the Margdarshak, requesting them to verify the User's status and encourage a check-in response.
- Steps 7–8: Further escalation with increased urgency, involving multiple contact attempts to the User, emergency contacts, and Margdarshak through all available channels.
- Step 9 — Manual Verification Only: Step 9 is never automated. It requires manual verification by the Company's designated team. No financial metadata is released to nominees without human confirmation that the escalation criteria have been fully met. This safeguard ensures that no data is ever released due to a system error, temporary unavailability, or a false alarm.
Nominee Access Modes
When nominee access is activated following the completion of the Life Signal protocol, the following modes may apply depending on the User's configuration:
- Locked Until Release: Nominees cannot see any financial metadata until the Life Signal protocol reaches Step 9 and manual verification is complete. This is the default and most secure mode.
- Live Read-Only:Select nominees (as configured by the User) may have read-only access to certain categories of metadata during the User's lifetime. This mode is intended for shared financial planning, such as between spouses.
The User retains full control over which nominees receive access, what categories of metadata they can view, and when such access becomes active. These settings can be modified at any time while the User's account is active.
8. Intellectual Property
All intellectual property rights in and to the Service — including but not limited to the Naksha brand, logo, software, user interface design, proprietary algorithms (including the Life Signal protocol and Readiness Score calculation), documentation, and all other materials — are and shall remain the exclusive property of Arthaprapti Fintech Solutions Pvt. Ltd.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial purposes in accordance with these Terms. You may not:
- Copy, modify, distribute, sell, or lease any part of the Service or its underlying software.
- Reverse-engineer, decompile, or disassemble the Service or attempt to extract its source code.
- Use any automated means (bots, scrapers, crawlers) to access or interact with the Service.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices displayed within the Service.
- Use the Naksha name, logo, or any Company trademarks without prior written consent.
All content you enter into Naksha (your financial metadata, nominee details, notes) remains your property. You grant us a limited licence to store, encrypt, process, and transmit this content solely for the purpose of providing the Service to you as described herein.
9. Termination
Termination by You
You may cancel your subscription and request account deletion at any time by contacting us at info@arthaprapti.com or through the account settings within the Service. Upon cancellation:
- Your access to the Service will continue until the end of your current billing cycle.
- Auto-renewal (if enabled) will be cancelled immediately.
- Your Life Signal check-ins will cease at the end of the billing cycle, and your nominees will be notified that the Life Signal has been deactivated.
Termination by Us
We may suspend or terminate your account immediately, without prior notice, if:
- You breach any provision of these Terms, including the User obligations outlined in Section 3.
- We are required to do so by law, regulation, or a court order.
- We reasonably believe your account is being used for fraudulent or illegal purposes.
- You fail to pay subscription fees that are due.
Data After Termination
Following account termination or cancellation, your encrypted data will be retained for a period of 7 years in accordance with applicable Indian financial and tax regulations. After the mandatory retention period, your data will be permanently deleted through a 30-day erasure process that includes cryptographic key destruction, ensuring that the data is irrecoverable.
You may request a copy of your data in a portable format before account deletion. Such requests must be made at least 14 days before the requested deletion date.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, availability, accuracy, or completeness of the Service.
- Naksha is a financial metadata organiser and not a financial advisor, legal consultant, or estate-planning service. We do not provide financial, legal, tax, or investment advice. You should consult qualified professionals for such matters.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from or related to your use of the Service.
- Our total aggregate liability for any claims arising under or related to these Terms shall not exceed the total amount paid by you to us in the 12 months preceding the event giving rise to the claim.
- We shall not be liable for delays, failures, or errors arising from circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, power outages, telecommunications failures, or third-party service interruptions.
Nothing in these Terms shall exclude or limit liability for fraud, gross negligence, wilful misconduct, or any liability that cannot be excluded or limited under applicable Indian law.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
Any disputes arising out of or in connection with these Terms, or the use of the Service, shall be subject to the exclusive jurisdiction of the courts located in Ranchi, Jharkhand, India.
Before initiating any legal proceedings, the parties agree to attempt to resolve the dispute through good-faith negotiation for a period of at least 30 days. If the dispute remains unresolved, either party may pursue legal remedies as permitted by law.
12. Changes to Terms
We reserve the right to modify, amend, or update these Terms at any time. When we make changes:
- We will provide at least 30 days' notice before the revised Terms take effect, communicated via email to your registered email address, in-app notification, or prominent notice on our website.
- The "Last updated" date at the top of this page will be revised to reflect the date of the most recent changes.
- Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must discontinue use of the Service and cancel your subscription.
For material changes that significantly affect your rights or obligations, we will make reasonable efforts to provide additional notice and may require you to re-acknowledge your acceptance before continuing to use the Service.
